Legislation and disability

The Employment Equality Act 1998 (EEA)

The EEA has relevance to employees within the Institutes of Technology because it prohibits discrimination in vocational training. The European Court of Justice however has long accepted that university and third level education can also constitute vocational training. So the legislative definition suggests that many third level courses may also be covered. Any course ‘required for the carrying on of an occupational activity' is a vocational training course and the students on that course are protected under the legislation.

Many courses on offer today come within this definition, courses such as engineering, dentistry or nursing.

The EEA is relevant to Institutes of Technology and participating students. It is also relevant to some courses at university and third level.
